Ajman Court Family Assault Case

Ajman Court Upholds Acquittal in Intricate Family Dispute

The Federal Court of Appeal in Ajman has reaffirmed the exoneration of a young man accused of assaulting his father, citing insufficient evidence to support the allegations.

The Genesis of the Family Conflict

The legal battle originated when the 22-year-old son lodged a complaint against his 67-year-old father, claiming he was assaulted within their residence. The conflict arose when the son refused to drop a legal case against one of his siblings, leading to a highly charged family dispute.

Documents from the legal proceedings reveal that a heated argument ensued after the father requested the son to retract his accusations. The son alleges that his father attacked him with a bamboo stick in the presence of family members, including his mother, sister, and cousin. Following the incident, the son reported the episode to the authorities.

Family Testimonies and Medical Evidence

The son’s mother backed his allegations during the investigation, stating that her husband indeed assaulted their son after he refused to comply with the father’s demands. Meanwhile, the father countered these claims, alleging that he was the one who was attacked during the confrontation.

Medical examinations post-incident documented scratches, a wound on the father’s left hand, and bruises on his head and chest, estimating a recovery period of three days. Based on this evidence, the Public Prosecution charged both father and son with assault, escalating the matter to court.

Surveillance Footage: A Critical Piece of Evidence

A pivotal element in the court’s deliberations was the surveillance camera footage captured within the household. The recordings revealed that the father entered a room armed with a wooden stick and struck his son multiple times. The footage later showed the son seizing the stick and breaking it in an apparent act of self-defense.

The Court of First Instance initially acquitted the son, citing inadequate evidence of his intent to harm his father. Conversely, the father was convicted, sentenced to six months in prison, and fined AED10,000.

Appeals and Judicial Reviews

The Public Prosecution contested the son’s acquittal, resulting in an appellate court overturning the initial ruling. The son was subsequently sentenced to one month in prison and fined AED5,000. However, the son appealed to the Federal Supreme Court, which overturned the conviction, citing a lack of detailed explanation supporting the son’s guilt. This prompted the case to be reviewed by a different panel at the Court of Appeal.

Final Verdict: An Exoneration Based on Doubt

Upon re-evaluation, the new judicial panel upheld the son’s version of events, supported by the surveillance footage. The court concluded that the son’s actions in seizing the stick were defensive rather than aggressive.

Judges further noted that the injuries documented on the father did not conclusively prove that the son intended harm, suggesting they might have occurred amid the struggle to disarm the father. Consequently, the court highlighted the principle that criminal convictions require certainty and that any doubt should favor the accused.

Thus, the court accepted the procedural appeal from the Public Prosecution but dismissed it on substantive grounds, reaffirming the son’s acquittal and closing this complex chapter in the family’s legal saga.
